Scope of Terms

These Terms are applicable to all Jinzora web sites, servers and services (the "Jinzora Network"), including all resources and tools provided through the Jinzora Network, including but not limited to download areas, forums, chat rooms, weblogs, RSS feeds, documentation and product information. These Terms also apply to the retrieval of information using the application called "Jinzora" or "Jinzora Media Server".

Jinzora

"Jinzora" or "Jinzora Media Server" is a web based media streaming and management system, written in PHP. Any references to "Jinzora" in these Terms refer to the application called "Jinzora" or "Jinzora Media Server".

Jinzora Network

References to the "Jinzora Network" in these Terms refer to all Jinzora web sites, servers and services, whether provided through a sponsored site, managed through a third party vendor or hosted by a third party.

Jinzora Services

"Jinzora" application features that retrieve metadata from the "Jinzora Network", including, but not limited to, metadata retrieval and similar artist and album lists are referred to as "Jinzora Services" in these Terms.

Jinzora Team

People who help in creating, developing, maintaining and improving "Jinzora" and the "Jinzora Network" and who are approved by individuals who are allowed to approve new team members, are referred to as the "Jinzora Team" in these Terms.

Legal Agreement

By accessing or using (referred to hereafter as "use", "usage" or "using") the Jinzora Network, you agree to be legally bound by the these Terms. If you do not agree to be legally bound by all or any of these Terms then please do not use the Jinzora Network.

We may change these Terms at any time without prior notice. It would be prudent to review our Terms regularly as your continued usage of the Jinzora Network means you agree to be legally bound by these Terms as they are updated and/or amended.

Unlawful or Prohibited Use

You agree that you will not use the Jinzora Network for any purpose that is illegal, unlawful, unethical or prohibited by these Terms. You may not:

1. upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, hateful, slanderous, abusive, harassing, tortuous, defamatory, vulgar, obscene, sexually-orientated, libelous, invasive of another's privacy, or racially, ethnically, legally or otherwise objectionable;
2. upload, post, email, transmit or otherwise make available any content that may violate any laws be it of your country, the countrys where the Jinzora Network is hosted or International Law.
3. upload, post, email, transmit or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
4. upload, post, email, transmit or otherwise make available any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
5. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
6. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
7. use the Jinzora Network to "stalk" or otherwise harass or harm another;
8. impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity or collect or store personal data about other users in connection with the prohibited conduct and activities;
9. forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Jinzora Network;
10. use the Jinzora Network in any manner that could damage, disable, overburden, or impair any Jinzora server, or network(s) connections, disobey any requirements, procedures, policies or regulations of networks connected to the Jinzora Network or interfere with any other party's use and enjoyment of the Jinzora Network;
11. attempt to gain unauthorized access to the Jinzora Network, other accounts, computer systems or networks connected to any Jinzora server, through hacking, password mining or any other means or obtain or attempt to obtain any materials or information through any means not intentionally made available through the Jinzora Network;
12. intentionally or unintentionally violate any applicable local, state, national or international law;

Violation of Terms

Violating these Terms may lead to you being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. Your IP address might be recorded to aid in enforcing these Terms and applicable laws. You agree that the Jinzora Team has the right to remove, edit, or move any content that is uploaded, posted, emailed, transmitted or otherwise made available through the Jinzora Network, at any time should we see fit, without prior notice or consent.

Disclaimer of Liability

Anyone using the Jinzora Network does so entirely at his or her own risk.

Exclusions of Warranty

The Jinzora Network is provided by the Jinzora Team as a service and are for informational purposes only. you expressly understand and agree that:

• your use of the Jinzora Network is at your sole risk and that the web sites, servers and services are provided "as is" and "as available" without any express or implied warranty of any kind including warranties of merchantability, noninfringement of intellectual property, or fitness for any particular purpose;
• any material downloaded or otherwise obtained through the Jinzora Network is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or other device or loss of data that results from the download of any such material;
• in no event shall the Jinzora Team be liable for any damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information) arising out of the use of or inability to use the web sites, servers or services, even if the Jinzora Team has been advised of the possibility of such damages;

Limitation of Liability

You expressly understand and agree that the Jinzora Team shall not be liable to you for:

• any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of any software, documents, provision of or failure to provide services, or information available from the Jinzora Network.
• any loss or damage which may be incurred by you, including but not limited to loss or damage as a result of any reliance placed by you on the completeness, accuracy or existence of any content, or any changes the Jinzora Team may make to the web sites, servers, services, documents, content or for any permanent or temporary cessation in the provision of the web sites (or any features within the web sites); or if applicable, your failure to keep your password or account details secure and confidential;
• these limitations on the Jinzora Team's liability shall apply whether or not the Jinzora Team has been advised of or should have been aware of the possibility of any such losses.

Indemnification

You agree to indemnify and hold the Jinzora Team, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit or otherwise make available through the Jinzora Network, your use of the Jinzora Network, your connection to the web sites, services or Services, your violation of these Terms or site specific Terms of Use, or your violation of any rights of another.

Accuracy and Completeness

The Jinzora Team does not warrant the accuracy or completeness of the information, text, graphics, links or other items contained within the Jinzora Network.

Changes and Updates

The Jinzora Team reserves the right to modify or discontinue, temporarily or permanently, web sites, servers or services (or any part thereof) with or without notice. The Jinzora Team may make changes to web sites, servers or services, or to the products described therein, at any time without notice. The Jinzora Team makes no commitment to update the web sites, servers or services.

Privacy

You agree to any information you have provided to the Jinzora Team or the Jinzora Network being stored. While this information will not be disclosed to any third party without your consent, except when required by law, the Jinzora Team shall not be held responsible for any hacking attempt that may lead to the data being compromised.
